On May 16, 2025, CalRecycle released updated draft regulations to implement SB 54, which is California’s extended producer responsibility (EPR) law applicable to single-use packaging and plastic food service ware. In 2024, CalRecycle held three public comment periods on proposed regulations to implement SB 54. However, in March 2025, before the regulations were finalized, Governor Newsom directed CalRecycle to restart the rulemaking process to ensure that SB 54 is implemented fairly.
The draft regulations released on May 16 are part of CalRecycle’s new rulemaking proceeding, and indicate the changes that CalRecycle has made to the proposed regulations released in December 2024. CalRecycle has also provided a “Discussion Document” indicating why it made changes to certain sections of the December 2024 version of the regulations.
A public workshop on the updated draft regulations is scheduled for May 27, 2025, from 10am to 4pm PDT, and the deadline for public comments is June 3, 2025.
